SYNOPSIS OF RULES & REGULATIONS OF CARLETON OAKS

The following is a synopsis of some of the rules found in the Declaration of Covenants, Conditions and Restrictions for Carleton Oaks.  For the exact wording of these rules, please review the original text.  Do not rely on this synopsis for definitions, meaning or accuracy.  This synopsis does not purport to alter or amend the Declaration and is provided only as a quick reference for owners.  (You can see the entire Declaration of Covenants, Conditions, and Restrictions on the screen by clicking here It will take about 60 seconds to load this 81 page document.)

All requests for changes to the exterior grounds must be approved by the ACC prior to the commencement of work.  Exterior changes include, but are not limited to, installation of pools, enclosures, fences and plantings, as well as placement of outdoor statuary, decorations, and removal of existing plantings.  ACC approval is not needed for replacement of exterior plantings if the new plantings are the same kind as those being removed and they are placed in the same location. (This rule applies most often when dead or dying plantings need replacement.)  ACC approval is not needed for interior alterations.  (Covenants, Conditions and Restrictions – Article XI.)

To apply to the ACC for approval, you must submit a completed Architectural Change Form. VEHICLES/PARKING

The following rules and regulations apply to the parking of vehicles within Carleton Oaks.”  Overnight parking is generally from midnight to 6:00AM.  (Covenants, Conditions and Restrictions – Section 12.2, paragraph B.)

1.      No parking of any vehicle overnight on the street. Parking overnight is permitted.

2.      No parking at any time of day on driveways  and common property, including the community parking area,  of  motorcycles, trucks, trailers, boats, vans in excess of 17 feet in length, campers, motor homes, buses, commercial vehicles of any type (i.e., any vehicle which has any exterior lettering or logo for the purpose of business advertisement, or has tools or equipment), pick-up trucks, (commercial or private, as well as those with caps or covers), non-passenger vans (i.e. any van which does not have a rear seat and side windows),

3.      No parking at any time of day on driveways and common property of vehicles over 80 inches in height, or those vehicles which do not have windows completely circling the vehicle’s exterior (similar to windows around a station wagon)

4.      The only exceptions to the above rules are commercial vehicles, vans or trucks which may be parked temporarily during daylight hours to deliver goods or furnish services.

 

5.      No overnight parking in the community parking area of permitted vehicles without an authorized pass (See above for prohibited vehicles).

 

6.      The area from sidewalk to sidewalk, that is, the area from one sidewalk (inclusive of the entire sidewalk) to the other sidewalk ((inclusive of the entire sidewalk) across the street, is common property.  It is a violation of the law as well as a violation of our Rules and Regulations to park across the sidewalk or on the apron (easement) of a driveway and is therefore not permitted.

Additional Rules and Regulations

7.   The owners and lessees of each Lot shall abide by each and every term and provision of the Declaration of the Covenants, Conditions and Restrictions, and each and every term and provision of the Articles of Incorporation and By-Laws of the Association.

 

8.   The owners and lessees of each Lot shall abide by each and every guideline and restriction as set forth in the Board-approved Architectural Guidelines in order to uphold a Community-wide Standard and to maintain the general plan of the development of the Community.

 

9.   No bicycles, tricycles, scooters, or other similar vehicles or toys shall be allowed to remain in the Common Areas, The walkways, sidewalks, and streets shall not be obstructed.

 

10.     Any damage to the Common Areas, property, or equipments of the Association caused by any Owner, his family member, guest, invitee or lessee shall be repaired or replaced at the expense of such Owner.

 

11.     An Owner will not park or position his vehicle so as to prevent access to another Lot. The Owners, their family members, guests, invitees, licensees, and lessees will obey the posted parking and traffic regulations installed for the safety and welfare of all Owners.

 

12.     No Owner shall do or permit any assembling or disassembling of motor vehicles, motorcycles, or other mechanical machinery except within his garage. Each Lot Owner shall be required to clean his driveway of any oil or other fluid discharged by a vehicle.

 

13.     Except as may be permitted in accordance with the Declaration or by Federal, state or local statute, no transmitting or receiving aerial or antenna shall be attached to or hung from any part of a Lot or the Common Areas.

 

14.     All garbage and refuse from the Lots shall be deposited with care in each Owner’s private garbage containers, which shall be placed so they are not visible from the Roads or from Adjoining Units. No garbage or refuse shall be deposited in any Common Area for any reason, except on the correct days of the week for pickup and removal. No littering shall be done or permitted on the Association Property.

 

15.     All Owners shall comply with the Use Restrictions as set forth in the Declaration of Covenants, Conditions and Restrictions.

 

16.     No garage doors shall be permitted to remain open except for temporary purposes, and the Board may adopt further rules for the regulation of the opening of garage doors.

 

17.     Authorized parking passes for permitted vehicles (Please click Exhibit B for a list of prohibited vehicles as defined by the HOA Documents) may be obtained from the property manager or from any Board member for parking at the community parking area. No pass may be given for a period longer than ten (10) days. Any pass requested for a period longer than ten (10) days will require the signature of three (3) Board members.

 

18.     Overnight parking passes for rental moving trucks, trailers, storage containers (pods) will be made available to residents moving in or out of the community. These passes will be for one (1) overnight parking either on the resident’s driveway or at the community parking area if space is available. An extension of one (1) night will be available to residents who request more time to move. No overnight parking of such vehicles, trailers, or storage containers (pods) is permitted on the street. A pass will not be issued to any resident to park a truck, trailer, or storage container that is oversized and unable to be parked on a driveway or, if space is available, in the community parking area.

 

19.     Any aquatic activity, including, but not limited to, boating, fishing, playing, swimming, or use of flotation devices, is forbidden on all lakes and other bodies of water within the Property.

 

20.     All requests for work shall be directed to the Management Company. The on-site maintenance man has been directed not to perform work requested directly by an owner unless the management company has first prepared a work order.

 

21.     Fruit trees of any kind may not be planted as the dropping of fruit poses a maintenance issue as well as the potential to attract rodents, pigs, and other wild animals from the Preserve.

 

22.     Residents may use the oak trees located in the front of their homes to decorate for the holidays. Holiday lighting may be displayed between November 15 and January 10 only. All other exterior lights must be approved by the ACC.

 

The Rules and Regulations may be modified, added to, or repealed in accordance with the By-Laws of the Association.
